These Terms of Service ("Terms") govern your access to and use of the custom Model Context Protocol (MCP) server (the "Service") provided by Sacred Garden ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

The Service is a custom MCP server that, with your explicit authorization, connects an AI assistant operated by you to your Google account(s)—including Google Drive and Gmail—so the assistant can read, search, create, edit, organize, and send content on your behalf as you instruct. The Service acts only on the requests you initiate.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and capable of forming a binding contract to use the Service. By using the Service you represent that you meet these requirements and that any Google account you connect is one you are authorized to access.

3. Your account and authorization

• You authorize the Service to access your Google data through Google's OAuth consent process. The scope of access is limited to what you approve.
• You are responsible for maintaining the security of your Google credentials and any device or environment from which you run the Service.
• You may revoke the Service's access at any time through your Google Account permissions.

4. Acceptable use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party right.
• Access, alter, or transmit data you are not authorized to handle.
• Send spam, malware, or unlawful, harassing, or deceptive content.
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or its infrastructure.
• Exceed or circumvent rate limits or usage restrictions imposed by Google or by us.

5. Your content and responsibility

The data the Service accesses (your files, emails, and other content) is yours. You are solely responsible for the instructions you give the assistant and the resulting actions—including any messages sent, files modified or deleted, or content shared. We are not responsible for actions taken at your direction. We recommend reviewing AI-generated output before relying on or transmitting it.

6. Third-party services

The Service relies on third-party platforms, including Google APIs and the AI model provider you configure. Your use of those services is governed by their own terms and policies, and their availability is outside our control. Your use of Google services through the Service must comply with the applicable Google Terms of Service and policies.

7. Privacy

Our handling of data is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you acknowledge that policy.

8. Intellectual property

The Service, including its software and underlying code, is owned by Sacred Garden and protected by applicable law. These Terms do not grant you any ownership rights in the Service. You retain all rights to your own content.

9. Availability and changes

The Service is provided on a best-effort basis and may be modified, suspended, or discontinued at any time without notice. We may update these Terms from time to time; material changes will be reflected by updating the "Last updated" date above. Continued use after changes take effect constitutes acceptance of the revised Terms.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE OR RELIABLE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SACRED GARDEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

12. Indemnification

You agree to indemnify and hold harmless Sacred Garden from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

13. Termination

You may stop using the Service and revoke its access at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination (including Sections 8, 10, 11, and 12) will survive.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which Sacred Garden operates, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction, unless otherwise required by applicable law.
